Article 21 - Criminal History Record Data Report by Allen County Police Department

8-21-1 Chapter 1

8-21-1-1

Pursuant to Indiana Code 5-2-5-7, police officers of the Allen County Police Department are hereby authorized to inspect and verify the facts set forth in applications for criminal history information about persons within the jurisdiction of the Allen County Police Department requested by persons, firms, or other organizations.

8-21-1-2

The Allen County Police Department is hereby authorized to charge a fee in the sum of Three Dollars ($3.00) to defray the cost of processing a request for inspection and to charge a fee in the sum of Seven Dollars ($7.00) to defray the cost of processing a request for release. However, the Allen County Police Department may not charge the fee for requests received from the Parent Locator Service of the Child Support Division of the State Department of Public Welfare.

The Allen County Police Department and all employees thereof shall edit information so that the only information released or inspected is information which has been requested and is limited criminal history information. "Limited criminal history" information means information with respect to any arrest, indictment information, or other formal criminal charge which must include a disposition. However, information about any arrest, indictment information, or other formal criminal charge which occurred less than one (1) year before the date of a request shall be considered a limited criminal history, even if no disposition has been entered.

The Allen County Police Department or its duly authorized representative who shall be selected by the Sheriff of Allen County is authorized to collect such fees and remit such fees at least monthly to the Allen County Auditor. A receipt for the criminal history record data report by the Sheriff or other person acting for the Sheriff shall be given to the party paying such fee with a duplicate copy of such form retained by the Allen County Police Department.

The Allen County Police Department certificate of criminal history record data report shall be receipted by the Allen County Auditor for deposit in the Allen County Police Account known hereby as the "criminal history record data report account," and such fees may be expended by the Sheriff of Allen County for any department purpose reasonably related to the performance of such record-keeping services. All expenditures from said "criminal history record data report account" shall be processed, appropriated, and allowed in the same manner as other claims by the County of Allen.
