General Copyright Policy for Media on Reserve
|
The Helmke Library will follow the general policies below for all non-print media except where special circumstances are noted.
- The Learning Resources Center (LRC) handles IPFW requests for duplicating audiovisual materials. The LRC duplicates any part of any copyrighted audiovisual material if permission to do so has been obtained from the copyright holder. Written permission is preferred; verbal permission is appropriate if given directly to the LRC by the copyright holder and is followed by a confirming written permission.
- The Library can assist users in contacting the copyright holder for this purpose. Limited duplication of copyrighted audiovisual materials may be permissible under the Fair Use guidelines in the Copyright Law. The LRC or the Document Delivery Librarian can assist users in determining whether the duplicating would fall under Fair Use.
- The instructor who chooses to duplicate audiovisual materials in the Libraries' collections, him/herself, whole or in part, must assume full responsibility for that action.
- The Library/LRC makes archival copies of copyrighted audiovisual materials in the Library's collections only with written permission of the copyright holder. The Copyright Law does not permit making archival copies of any material except computer software without the permission of the copyright holder.
- If multiple copies of copyrighted audiovisual materials are needed, they must be purchased unless duplication permission is obtained from the copyright holder.
- Duplication of audiovisual materials is allowed for reservation purposes if unused copies are no longer available at a fair price. Before authorizing the duplication, the Librarian will document attempts to locate a new copy.
- Duplication from one international standard to another will be made only with the express written permission of the copyright holder. For example, conversion of a program from PAL (European) or SECAM (Asian) to NTSC (North American) standard will be done only with the noted written permission. Standard conversion will also involve the Department of Modern Foreign Languages. Determination that an NTSC copy cannot be acquired will be made before duplication to NTSC is done.
